New Rules for Crew Stamping in/out of the Schengen Zone in the Balearics

SPAIN – BALEARICS IMMIGRATION 

BWA Yachting Spain share some IMPORTANT information on new immigration rules.

On the 14th of December, the border police in MALLORCA issued an official statement regarding changes to the stamping IN/OUT of crew in Mallorca. 

The document states the following: 

  1. New Rules will be in force from the 1st of January 2024 

  2. From the 1st of January, the Border police will only stamp crew OUT of the Schengen Zone, if they have a Seaman’s Book.* They will no longer accept a work contract in lieu of a Seaman’s Book.

  3. Therefore, non-EU/Schengen crew that fly into the Balearics to work on a yacht without a Seamans Book, will not be stamped OUT and their 90 days allowance will count down. 

  4. Crew must not overstay their 90-day allowance. 

  5. These rules will apply to all yacht crew, regardless of the vessel’s flag. 

  6. Likewise, all crew members who want to disembark and enter Spanish territory will be required to have a travel booking to leave the Schengen Zone within the 90 days (their tourist stay allowance) and to prove they have the economic means to support themselves during their stay (108€ per person per day). They will also require proof of accommodation, either a booking or a “letter of invitation”. 

  7. Crew that would like to disembark prior to their departure may stamp IN on the day of their flight or the day before. They must still comply with the 90-day limit. 

 



RULES IN MAINLAND SPAIN REMAIN UNCHANGED


Please note, BWA Yachting have spoken to the Border Police in other areas, and they have confirmed that the rules for Stamping IN/OUT of crew are not changing in Barcelona or Tarragona. 

 

 

* SEAMEN'S DISCHARGE BOOK:
Issued by the flag state of the country of origin of the crew member, or flag state of the vessel employed on, as a record of service on all vessels worked.
* The PYA shares very useful information on the Seamans Book, and different flag states
* For UK citizens or crew who have worked on a UK-flagged yacht, they can apply for an MCA Seamans Book.
